Terms and Conditions

1. Enrolment Policies 

(a) All B&W classes have a maximum capacity of student numbers for health and safety reasons. 

(b) Enrolment to a class is on a first come first serve basis.  If you miss an intake to a class a waiting list is available. 

(c) B&W classes commence on the first week of each school term and run for a period of 9 or 10 weeks, depending on the relevant term (an “Enrolment Term”). 

(d) Students shall be automatically re-enrolled for the following Enrolment Term for classes they are currently enrolled in for any Enrolment Term.  If a student does not wish to attend a class for the following Enrolment Term, written notice must be provided in accordance with clause 1(e). If a student does not provide the required notice, you will be liable for full payment of the fees for the relevant Enrolment Term in accordance with clauses 2 and 3. 

(e) If at any time a student wishes to terminate his / her enrolment for any class, written notice must be provided to B&W at the following email address: blackwhitedancestudio@gmail.com.  For avoidance of doubt, verbal cancellation will not be accepted. 

2. Fee Policies 

(a) Enrolment Term fees are payable in full within the week prior to the first day of the relevant Enrolment Term. 
(b) Full payment of Enrolment Term fees is due regardless of whether or not the student attends classes. 
(c) B&W does not accept part payment of fees except in accordance with clause 5. 
(d) If B&W believes, in its sole discretion, that a class will reach its maximum capacity, B&W reserves the right to ask for immediate payment of fees to secure a student’s place. 
(e) Failure to make payment as noted in clause 2(c) within 3 days of receipt of the payment request means B&W shall be able to forfeit the student’s place in the intending class. 

3. Fees 

(a) The following fees are currently applicable for an Enrolment Term and are the total fees for each Enrolment Term: 
(1) All classes are $140 - 1 class/week; 
(2) Preschoolers Dance Fusion $115; 
(3) Trial class preschoolers - $15;

(4) Trial class all other classes - $20.

 

 
(b) For the avoidance of doubt, the fees noted at clauses 3(a)(1), (2) and (3) are based on a 9 to 10-week Enrolment Term, with a minimum number of 9 weeks, to take into account any consideration for a statutory holiday. 

 
(c) Fees are: 
(1)  not refundable for missed classes; and 
(2) not reduced or refunded for sickness.                                                                                                  (3) Failure to pay the fees may result in the loss of the student’s enrolment and penalty charges as noted at clause 3(e). 

(4) Missed classes can not be credited for future classes.

 
(e) If fee payment is not received by the beginning of week four (4) of an Enrolment Term, you acknowledge and agree that B&W will add a 18% /week penalty fee to the full Enrolment Term fee payable. 

 
(f) If fees remain unpaid at the end of an Enrolment Term, B&W may in its sole discretion: 
(1) exclude students from annual performances; and 
(2) engage a debt collection agency to recover the fees.  You will be liable for any additional costs associated with the debt collection and recovery. 

 
(g) B&W may amend the fees set out at 3(a), and the new fees shall apply from the start of the next Enrolment Term.  B&W shall notify you 4 weeks before the start of next Enrolment Term if there are any changes to the fees. 

 
 

4. Refund and Cancellation Policy 

(a) B&W will not give a refund after the 2nd class of the paid term in any circumstances, including, without limitation: 

(1) Absences from classes due to illness, injury or personal circumstances.             

(2) Classes missed due to a change in mind.                                                              

(3) Classes missed due to holidays.                                                                           

(4) Classes missed due to public holidays.                                                                 

(5) Cancellation of enrolment by the student. 

(b) If a student’s enrolment is cancelled prior to the start of week three of an Enrolment Term B&W will refund the fees paid by the student, less a proportionate cost for any classes attended by the student, provided that the student has notified B&W of the cancellation in accordance with clause 1(e). 

 
(c) If B&W cancels a class once an Enrolment Term has begun, B&W will refund the fees received less a proportionate cost for the classes that have taken place during the Enrolment Term prior to cancellation.

 

 

5. Payment Options 

(a) Payment of the fees can be made via the following options: 
(1) Internet banking to B&W’s ASB bank account: 12-3629-0884580-00. 
(2) Cash at the B&W studio by appointment only. 

 

6. Behaviour Expectation 

(a) All students are expected to show up on time for class each week in appropriate attire. 

(b) B&W strives to maintain a friendly healthy environment for learning, all students and parents/caregivers must show respect towards the teacher, B&W management, other parent/caregivers and other students at all times.  

(c) No food is permitted in the studio 

(d) Chewing gum and bubble gum is strictly forbidden. 
 

7. Class Attire and Uniforms 

(a) B&W does not have a specific uniform requirement, although shoes are essential. 

(b) Students may NOT attend class in bare feet, no dancing in socks is permitted. 
 

8. Health, Safety, Injury and Medical Policies and Procedures 

(a) While B&W takes all reasonable care in the conduct of its classes, it or any B&W related company, contractor or employee of B&W, does not: 
(1) accept responsibility for personal injury or loss caused during a class or while students are at the Rise premises. 

(2) accept responsibility for any loss of, or damage to, personal property whilst on the B&W premises. 

 
(b) B&W aims to provide a safe environment to reduce the risk of injury. However, it is acknowledged by the student and the parent/caregiver that dance by its nature carries a risk of accident or injury. 

 
(c) It is the responsibility of the student or parent/caregiver to notify the teacher in the event of an injury or medical condition prior to class. Students and parents/caregivers are responsible to ensure that their child/ren are physically and mentally fit to attend a class. 

(d) B&W provides teachers that actively promote safe dance practices and are qualified and/or experienced and well trained in dance. However, it remains the student’s responsibility to ensure that they follow safe practices to avoid injury. At all times during a class students are responsible for their own personal safety and must conduct themselves in a way that does not put themselves or others at risk. 

(e) A first aid kit is available to any student with permission from the teacher. 

(f) B&W students are only under supervision whilst in class time only. Teachers and staff will not be responsible for students outside their allocated class time and children in waiting areas must be supervised at all times. For safety reasons, students must be collected from inside the B&W premises. It is the responsibility of the parent/caregiver to ensure their child/ren do not wait outside the building. If a parent/caregiver is more than 10 minutes late in collecting their child/ren from a final class of the evening and B&W is required to keep the premises open, B&W will be entitled to charge a late pick up fee of $10 per 5-minute time slot. 


 

9. Photography and Video Policies 

(a) Photography and videoing of students in class and concerts is not permitted. This is for the safety and wellbeing of each student and to comply with the Privacy Act 1993 regulations. 

(b) Images or video footage of students taken by B&W may be used for marketing and website purposes and remains the sole property of B&W. Please make B&W aware if you do not wish for your child to appear in any marketing or promotional photos. 
(c) Any footage of any choreography taken by a parent/caregiver or student remains the property of B&W. 

10. Annual Performance 

(a) All students enrolled at B&W are invited to dance in the annual performance which takes place in December. 

(b) Each student that participates in the annual performance is required to attend extra rehearsals and all performances they are allocated to perform in. 

(c) In addition to clause 10, all recording at the annual performance is prohibited due to copyright and privacy laws. The annual performance is recorded and a professional DVD/USB and photographs are available for purchase direct from the outsourced contractor. 

(d) Tickets to the annual performance are an additional cost. You will be notified by B&W when the tickets become available. 

12. Choreography and Music 

(a) B&W is licensed with APRA for the use of music for teaching and performance purposes. 
(b) Choreography for classes, competitions, and performances remains the sole property of B&W. 
(c) Choreography must not be copied or used without prior permission from B&W. 

13. Concerns or Complaints 

(a) We value your opinion and hope to make you and your child’s involvement with B&W as enjoyable as possible. If you wish to speak to us about any concerns please feel free to contact us at the office via phone or email. 
(b) If you are not happy with the service you have received or the behavior or attitude of any staff member please tell us as we may be unaware there is an issue. 

14. Privacy Act and Privacy Policy 

(a) To ensure we have all relevant personal details about our students, we will collect and keep information about you from time to time. 
(b) This information includes the information you provide on your enrolment form and updates you may provide us with. 
(c) You need to ensure that the information you give us is true, correct and complete. 
(d) Under the Privacy Act 1993 you are entitled to have access to, and request correction of this information. 
(e) Please note we do operate CCTV in some of our studios for safety purposes. All recordings will remain private and confidential property of B&W

16. Communication Policy 

(a) It is the responsibility of all parents and students to read emailed newsletters.  Please note we do not provide printed copies of newsletters. 

(b) If you have not received our newsletter via email, please check your junk inbox, you may need to make us a safe sender.
